Please read these Terms and Conditions carefully, as they contain important information regarding your legal rights, remedies, and obligations, and in using this website, you are deemed to have read and agreed to the following Terms and Conditions.

The Brieogletree.com website allows users to receive information about BOgletree LLC (also doing business as Brie Ogletree and Intuitive Strength Coaching) as well as book classes, cancel, and pay for services and products offered by Brie Ogletree, Intuitive Strength Coaching, and BOgletree LLC.

BOOKING POLICY

​

To book a class at Brieogletree.com, you must have a valid class credit or membership to reserve a spot. To buy an individual class credit or membership, you can either sign up on brieogletree.com by using your email and creating a password or if you are already registered, click login to buy a class credit or membership and make your reservation.

CANCELLATION POLICY

​

Private Sessions

You must cancel your session 24 hours or more prior to your session start time in order to un-reserve your spot and return it to your account.

​

If you late-cancel less than 24 hours prior to your session start time, your session will be forfeited.

Cancellations via email, Facebook Messenger, Instagram, or text message will not be taken, and you will be charged.

​

Virtual Group Sessions (Fitness Classes)

​

You must cancel your session 4 hours or more prior to class start time in order to un-reserve your spot and return it to your account.

​

If you late-cancel less than 4 hours prior to class start time, your session will be forfeited.

Cancellations via email, Facebook Messenger, Instagram, or text message will not be taken, and you will be charged.

 

NO SHOW POLICY

​

If you do not show up to class and do not cancel, your class or private session will be forfeited. 

 

WAITLIST POLICY

​

If you book multiple classes or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy. Intuitive Strength Coaching staff cannot be held responsible for accidental bookings by clients or double bookings or double waitlisted classes made by clients. Late cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings.

The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel and spots will be assigned as such.

​

Intuitive Strength Coaching staff will add walk-in, waitlisted clients in the order in which they were added to the waitlist by the computer system, top to bottom, 2 minutes before the start of class. There is no waitlist priority given for early arrival.

RETAIL RETURN AND EXCHANGE POLICY

​

All retail returns and exchanges must be returned or exchanged 30 days from the date of purchase. Clothing must be in original condition, unworn and unwashed with ALL original tags attached. Clothing with marks from makeup or deodorant will not be taken back. Intuitive Strength Coaching staff has sole discretion in authorizing returns and exchanges.

AUTO-DEBITED CONTRACTS

​

The following terms and conditions apply if you are enrolled in an auto-debit contract:

I, the Client, authorize BOgletree LLC (to include DBA Brie Ogletree and Intuitive Strength Coaching) to, on a recurring basis, automatically charge the debit or credit card account I specified, for monthly payments due on my auto-debit plan associated with my account. 

I understand that BOgletree LLC will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on my auto debit contract and/or in connection with cancellation fees according to the Intuitive Strength Coaching cancellation policy.  Intuitive Strength Coaching will initiate charges each month on the date my contract is set to renew.

BOgletree LLC may discontinue processing of recurring charges if the company is unable to secure funds from my debit or credit card I have authorized due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information I provided.

By continuing to use our services, you agree to the statements above regarding auto-debited contracts and memberships.

COLLECTION OF INFORMATION

​

We collect personally identifiable information, such as names, phone numbers, postal addresses, email addresses, credit card information and etcetera when it is voluntarily submitted by our members and/or visitors. If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept sole responsibility for all activities that occur under your account or password.

 

Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails, phone calls, mobile text messages, and newsletters from this site allow you to opt out of future marketing communication. We use industry-standard efforts to safeguard the confidentiality of your personal information, including the use of firewalls and secure sockets layer software where appropriate. We do not sell your information to anyone.

BOgletree LLC reserves the right to refuse, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

WAIVER & RELEASE POLICY

​

Because physical exercise can be strenuous and subject to risk of serious injury, BOgletree LLC (also doing business as Brie Ogletree and Intuitive Strength Coaching) urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (each member, guest, or participant) agree that if you engage in any physical exercise or activity, or use any company amenity on the premises or off premises including any sponsored company event, you do so entirely at your own risk. You agree that you are voluntarily participating in these activities and use of this equipment and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.

This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations and (d) your slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas.

You acknowledge that you have carefully read this "waiver and release" and fully understand that it is a release of liability. You expressly agree to release and discharge BOgletree LLC, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the company for negligence, personal injury or property damage.

Photographic Release: I grant BOgletree LLC  (also DBA Brie Ogletree and Intuitive Strength Coaching) all right, title and interest in any and all photographic images and video or audio recordings made by BOgletree LLC in connection with my membership and participation, including, but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings. I agree that BOgletree LLC may use such photographic images, video and audio recordings with or without my name and for any lawful purpose, including publicity, illustration, advertising, social media and web content.

Note: Should any part of this agreement be found by a court of law to be against public policy or in violation of any state statute or case precedence, then the remainder of this document will remain in full force.
